Please support amending the Capital Investment bills (HF4404/SF*) to remove the “must be paved” language in Minn. Statutes 85.015. Removal of the “must be paved” requirement will give the DNR the ability to determine the most appropriate surface for the state trail in an area that is prone to frequent flooding. The “must be paved” language was inserted in 2015 without discussion, notice or public hearings. Removing the “must be paved” language will allow the DNR to determine the most sustainable and fiscally responsible trail surface in an area that floods frequently. The DNR has recently reported the deficit in trail maintenance is over $300 million and, in February, testified in committee that the DNR’s focus is on restoring and maintaining assets not “building shiny new assets.”
